These Terms of Use apply to TheAppShelf.com website and all associated linked sites, hereby collectively referred to as “the Site” or "Site." BY USING THE SITE, YOU ARE AGREEING TO THESE TERMS OF USE, IF YOU DO NOT AGREE, DO NOT USE THE SITE.

You will not try to access, acquire, monitor, copy, or data mine, any part of the Site for which you are not given that specific intended access. TheAppShelf.com reserves the right to bar access to any of the aforementioned activity which it deems fit.
You may not attempt to breach the security of the Site or any linked or affiliated sites. This expressly includes all private information and secure transactions, such as those through paypal.
You may not interfere, intentionally or otherwise, with the workings of the Site, or take any action that may cause the Site to “go down.”

Reviews, articles, application price listings, and various other content are considered current only at time of posting and only for the current version of the application at the time of posting. TheAppShelf.com has no obligation to update reviews, articles, feature summaries, price listings, or other related content should they change after posting.
TheAppShelf.com may make changes to the Site at any given time without notice, including services offered. TheAppShelf.com makes no commitment to update the Site or any of its content. All reviews, shelf displays, feature articles, and any other similar or related content are considered to be current only at the time of posting. All Terms, Services, Contests, and Promotions on the Site are void where prohibited.

Products Provided
TheAppShelf.com reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Service at any time. Changes take place immediately upon posting. It is your responsibility to check these Terms of Service periodically for changes. By submitting any content, news, applications, promotional codes, or any other materials to TheAppShelf.com, you agree to our Terms of Service. BY MAKING A SUBMISSION OF ANY KIND TO THEAPPSHELF.COM, YOU ARE AGREEING TO THESE TERMS OF SERVICE, IF YOU DO NOT AGREE, DO NOT MAKE SUBMISSIONS TO THE SITE OR ASSOCIATED EMAIL ADDRESSES.
- Four (4) Weeks in AppShelf section
- 1st week on front page first visible shelf of apps (no absolute position guaranteed)
- 2nd week on front page second visible shelf of apps which is visible by clicking the right arrow one time.
- 3rd week on front page third visible shelf of apps which is visible by clicking the right arrow two times.
- 4th week on front page fourth visible shelf of apps which is visible by clicking the right arrow three times.
- Brief front page summary article dedicated to your app. (This is not required to fulfill Terms of Service. Date, time, length and duration of front-page display are contingent upon numerous factors and therefore not guaranteed. Purchaser provides the content for the feature. TheAppShelf.com's posters reserve the right to approve and/or edit this content as they deem fit.)
Expectations of Service:
- Our Site will be up at least 90% of the time during the period your app is to be displayed except as stated in our Terms of Use, Site Use, and Service.
- Our week spans from Tuesday at 12:00 AM EST to Sunday at 12:00 AM EST, but may be longer.
We Do Not Guarantee:
- Your app will be formally reviewed on our site.
- Your app sales will increase
- There will be an increased interest in you, your app, your site, or anything else.
- A specific week will be available for advertising.
- Any specific number of page views
- An app appearing in the app shelf section has purchased a spot there
- Anything that is not in our "Expectations of Service" section above
If you feel we have not met our obligations stated under the "Expectations of Service" section, it is up to you to contact us for compensation, and you may be compensated up to, but not exceeding, the amounts listed below:
- During the first week: 50% of price
- During the second week: 17% of price
- During the third week: 17% of price
- During the fourth week: 16% of price
All claims must be made within 30 days of the occurrence or are considered forfeit.
TheAppShelf.com does not, in any way, guarantee the expectations listed above in our "Expectations of Service" section. Instead, the expectations are provided as a convenience to our customers. Payment, once accepted, is considered to be non-refundable. All risk for any services not partially or fully provided is assumed by the purchaser upon payment.
The purchaser of said service acknowledges and agrees that TheAppShelf.com has no obligation to provide any of its services, even after receipt of payment. In such cases where TheAppShelf.com does not provide some or any of its offered services after payment has been made, the purchaser may request compensation for any service not provided. It is solely the purchaser's responsibility to request such reimbursement. Compensation will under no circumstances exceed the amounts listed above. COMPENSATION WILL, UNDER NO CIRCUMSTANCE, EXCEED THE AMOUNTS LISTED ABOVE, AND FURTHER, NEVER EXCEED THE ORIGINAL AMOUNT PAID. By using the Site or any of its services, the purchaser agrees that TheAppShelf.com has final and absolute say on the amount of any reimbursement given, and that TheAppShelf.com reserves the right to deny any reimbursements or compensations at its sole discretion.You will provide us with the following:
- Intent to be on our site along with 1 promotional code (if available) for your app at least 2 weeks before your visible week begins. (Promo code is Non-refundable and may give you preference to begin the approval process. This process does not guarantee the approval of your application. A promo code is not required for submission or evaluation process; you may submit without one).
- If approved, you will need to send us the content for your "featured article" by the Sunday, 1 week before your display week begins so we can review, approve, and edit the content as necessary.
- By sending this information you give us the right to use the information for your informational page, any reviews/articles on our site, and any ad we decide to run to promote our site.
- If approved, you will need to send payment by the Friday prior to your display week or your application will not be displayed that week.
Approval Process:
- Once we have received your intent, we will evaluate the quality of your app and give it a rough score of 1 through 5. We will reject any application from being in the AppShelf that rates lower than 3, and will notify you of your app's rejection. By submitting your application, you agree that this evaluation is left solely to our discretion and opinion of your app.
- Providing a promo code with your application may accelerate your application process, but will have no affect on our evaluation of your app.
- If you meet first approval, you may then provide TheAppShelf.com with content that you wish to be considered for your app's "featured article." The article itself will be created by one of TheAppShelf.com's posters. If you provide no content for a featured article, a featured article may not be posted for your app. The final content of the ad is left to the sole discretion of TheAppShelf.com and its posters.
- After you have received first approval, payment is then required for final approval. Upon receipt of payment, your app display advertisement will be set for display on our virtual shelf.
We reserve the right to deny any submission, application, or advertisement for any reason.
We also reserve the right to cancel any submission, application, or advertisement, under the same reimbursement policy listed above (reimbursement occurs only if we've been paid) for any reason.
TheAppShelf.com reserves the right to make all final decisions on advertisements and app displays. We also reserve the right to give preference to any app or advertisement at our discretion for such purposes as reader benefit, themed app weeks, site quality, site diversity, or any other reason we deem fit.
While advertisements for the Site will primarily function on a "first come, first serve" basis, this is not a condition of the Site or the services provided. TheAppShelf.com reserves the right to choose display preference and order as we deem fit.
Many of these same terms and conditions apply to traditional site advertising, with a notable exception being we will not review your application or product for quality. Traditional site advertisements, such as side banner ads, do not qualify for the Site's assurance of quality. Traditional advertising opportunities are currently determined through contact via email. Any terms and conditions set forth by TheAppShelf.com representatives in those communications are included in these Terms of Service by this reference.

Due to a high volume of developer submissions, we cannot promise a personal reply to every submission, but we do try to read and evaluate all emails and apps submitted. Submission does not guarantee approval; space is limited. If your submission is approved, we do not guarantee any specific time frame for you to be notified, or any specific week for your app to be displayed.
