1. About TheAppShelf

TheAppShelf provides downloadable digital products, including Windows desktop apps, customer ZIP files, PDF guides, templates, support materials and related digital resources.

By using this website, purchasing a product, downloading customer files or using a TheAppShelf app, you agree to these Terms of Use.

2. Digital Products

TheAppShelf products are supplied digitally. After purchase, you may receive access to one or more files such as a Windows installer, ZIP package, PDF guides, licence terms and version information.

No physical product is shipped unless a product page specifically states otherwise.

You are responsible for reviewing the product description, system requirements and included-file information before purchasing.

3. Windows App Requirements

TheAppShelf currently offers Windows desktop applications. Individual product pages state the Windows versions, computer requirements and other compatibility information that apply to each product.

Unless a product page clearly states otherwise, a Windows application should not be assumed to work natively on macOS, iPad, iPhone, Chromebook or Android devices.

You are responsible for checking that your computer meets the stated requirements before purchasing.

4. Installation and Security Messages

Some Windows computers may display a Microsoft SmartScreen or other security message when an application from an independent developer is opened. If this occurs, follow the installation guidance supplied with your product.

Only install TheAppShelf software obtained from the official download provided following your purchase. Do not install copies obtained from unknown websites, file-sharing services or unofficial sources.

5. Licence to Use Purchased Apps

When you purchase a TheAppShelf app, you receive a limited, non-exclusive, non-transferable licence to use the app subject to the product-specific licence terms supplied with your purchase.

The number of users, permitted installations and other licence conditions are determined by the licence terms applicable to the individual product.

Unless the applicable product licence states otherwise, graphics, designs, exports or other original content you create using the app may be used for your own personal or commercial purposes.

6. What You May Not Do

Unless expressly permitted by the applicable product licence, you may not:

• Resell, share, upload or redistribute an app installer, ZIP package or customer download files.
• Claim TheAppShelf apps, templates, files or guides as your own software product.
• Sell, rent, sublicense or transfer your software licence or download access to another person.
• Reverse engineer, decompile or attempt to extract protected source code except where applicable law expressly permits it.
• Use the website or products for unlawful, harmful, fraudulent or abusive purposes.
• Upload paid TheAppShelf customer files to public file-sharing sites, marketplaces or groups.

7. Pinterest and Other Third-Party Platforms

Pin Traffic Studio helps users create Pinterest-style graphics and prepare information for manual Pinterest upload.

It does not automatically publish pins, log into Pinterest on the customer's behalf, guarantee posting, guarantee Pinterest traffic or guarantee sales.

Pinterest and other third-party platforms are separate services. You are responsible for complying with the terms, policies and requirements of any third-party platform you choose to use.

Pin Traffic Studio is an independent product and is not affiliated with, endorsed by, sponsored by or officially connected with Pinterest.

8. Product Results and No Guarantees

TheAppShelf products are tools intended to assist with activities such as design, organisation, marketing preparation, content creation and digital workflows.

We do not guarantee that using a product will produce traffic, clicks, rankings, sales, income, followers, engagement, conversions or business success.

Results depend on many factors outside the software, including your content, audience, offer, marketing activity, platform use and business decisions.

9. Downloads and Customer Access

After purchase, use the official purchase confirmation and download information supplied for your transaction to obtain your customer files.

You are responsible for downloading and keeping a reasonable backup copy of your purchased customer files.

If you cannot locate or access your download, contact TheAppShelf Support and include the email address used for the purchase.

We may update or replace product files from time to time. Access to future major versions or future paid products is not guaranteed unless the applicable product page or purchase terms specifically state otherwise.

10. Refunds and 14-Day Money-Back Guarantee

Certain TheAppShelf products are sold with a voluntary 14-Day Money-Back Guarantee.

Where that guarantee is advertised for a product, you may request a refund within 14 days from the date of purchase in accordance with our published Refund Policy.

The voluntary guarantee is additional to, and does not replace or restrict, any rights you may have under applicable consumer protection law.

11. Australian Consumer Law

Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.

Australian consumers may have rights and remedies under the Australian Consumer Law where goods or services do not meet applicable consumer guarantees.

Depending on the circumstances, available remedies may include repair, replacement, refund or compensation as required by law.

12. Website Content

The content on TheAppShelf.com is provided primarily to describe and support TheAppShelf products.

We aim to keep product information accurate and current, but products, features, screenshots, prices, descriptions, documentation and availability may be updated from time to time.

If you believe information on a page is incorrect or materially affects a purchase you have made, please contact support.

13. Prices, Checkout and Payments

Product prices are displayed on the applicable sales page or checkout page. Prices may change from time to time. A later price change does not normally alter an order that has already been completed.

TheAppShelf may use JVZoo and supported payment processors to process purchases. Depending on the transaction, JVZoo, a payment provider or another applicable party may process the payment and transaction information.

The checkout page presented for your purchase will identify the payment methods and transaction process available for that order.

TheAppShelf does not directly store your complete credit or debit card details when those details are collected and processed by the applicable checkout or payment provider.

14. JVZoo Purchases

Where a TheAppShelf product is purchased through JVZoo, the transaction is also subject to the applicable JVZoo checkout terms, policies and payment arrangements.

Depending on the transaction structure, JVZoo, a payment facilitator or another applicable party may act as merchant of record or process the payment.

Regardless of the payment-processing arrangement, TheAppShelf remains responsible for its products, customer fulfilment, product support and product-related claims as required by applicable law and the relevant platform arrangements.

15. Purchase and Order Information

You are responsible for providing accurate information when completing a purchase, including a valid email address.

Purchase confirmations, receipts and download information may be sent to the email address supplied during checkout.

If you provide an incorrect email address or cannot access your purchase information, contact support as soon as possible.

If a checkout or payment service provides you with an account, login or customer portal, you are responsible for keeping those account credentials secure.

16. Intellectual Property

TheAppShelf names, branding, website content, application interfaces, downloadable files, guides, templates, product materials and related assets are owned by TheAppShelf or used with appropriate permission.

Purchasing a product gives you the right to use that product according to the applicable licence terms. It does not transfer ownership of the software, underlying files, templates, documentation or TheAppShelf brand assets.

17. Affiliate Program

TheAppShelf uses JVZoo for affiliate promotion of participating products.

Affiliates must comply with the applicable JVZoo rules and TheAppShelf Affiliate Terms & Conditions.

Affiliate approval, commission rates and other promotion conditions may vary by product.

18. Limitation of Liability

To the maximum extent permitted by law, TheAppShelf is not responsible for losses arising solely from circumstances outside our reasonable control, including third-party platform availability, user marketing results or unauthorised use of customer files.

Nothing in these Terms is intended to exclude, restrict or modify any liability, consumer guarantee, right or remedy that cannot legally be excluded.

19. Changes to These Terms

We may update these Terms of Use from time to time. The version published on this website applies when you use the website or make a purchase, subject to any rights that cannot legally be excluded.
